1. Carisma を利用できる方
18歳以上であり、本規約に同意する法的能力があり、サービスの利用を禁じられておらず、過去に Carisma から削除されたことがない方に限ります。アカウントはお一人につき1つです。
2. アカウント
サインイン情報は安全に管理してください。アカウント上の行為についてはお客様が責任を負います。本名または通称、そしてご本人の写真を使用してください。
3. コミュニティのルール
お客様はコミュニティガイドラインを守ることに同意します。ハラスメント、脅迫、ヘイト、露骨または望まれない性的コンテンツ、性的サービスやエスコートの勧誘、詐欺や金銭の要求、なりすまし、スパム、未成年者に関わる一切の行為を禁止します。
4. お客様のコンテンツ
投稿したコンテンツの権利はお客様に帰属します。お客様は当社に対し、Carisma の運営のみを目的として、コンテンツをホスト、保存、確認、翻訳し、他のメンバーに表示するための、全世界的・非独占的・無償のライセンスを付与します。ライセンスは、コンテンツまたはアカウントの削除により終了します。ただし、プライバシーポリシーに記載のとおり安全のために保持されるコンテンツを除きます。
5. モデレーション
写真と動画は表示前に確認し、通報も審査します。本規約または法律に違反するアカウントについて、コンテンツの削除、機能の制限、アカウントの一時停止または永久停止を行うことがあり、法律や安全上の理由で妨げられない限り理由をお伝えします。決定に異議がある場合は [email protected] までご連絡ください。
6. 安全
当社は犯罪歴の調査を行っておらず、いかなる人の身元や行動も保証できません。認証マークは、スタッフが自撮り写真をプロフィール写真と照合して承認したことを意味するにすぎません。公共の場所で会い、安全のためのヒントをお読みください。緊急時は地域の緊急サービスに連絡してください。
7. Carisma Premium
- —Premium は、1か月・6か月・12か月の任意の自動更新サブスクリプションで、Apple (App Store) または Google (Google Play) を通じてストアのアカウントに請求されます。
- —価格は購入前にアプリ内で現地通貨で表示されます。
- —現在の期間終了の24時間前までに解約しない限り、同じ期間で当時の価格により自動更新されます。ストアのアカウントには更新前24時間以内に請求されます。
- —App Store または Google Play のサブスクリプション設定で解約してください。Carisma のアカウントを削除しても、サブスクリプションは解約されません。
- —返金は Apple または Google が各社のポリシーに基づいて対応します。
- —Premium が終了した場合、海外のメンバーとの会話は引き続き閲覧できますが、閲覧専用になります。削除されるものはありません。
- —Premium の内容は変更されることがあります。内容を縮小する変更が支払い済みの期間に影響する前にお知らせします。
8. アカウントの削除
アカウントはアプリでいつでも削除できます（あなた → 設定 → アカウントを削除）。削除は取り消せません。
9. サービスの提供
Carisma の安定運営に努めますが、サービスは変更・一時停止・終了する場合があります。機能を更新することがあります。
10. 責任の制限およびリスクの引き受け
1. 身元調査は行いません
Carisma は犯罪歴の調査を行わず、公的な身分証明書の確認も行いません。当社が行っていること：プロフィール写真はすべて、他のメンバーに表示される前に確認されます。また、プロフィール認証を選択した場合は、スタッフがあなたの自撮り写真とプロフィール写真を照合します。青い認証マークは、その自撮り写真が一致したことのみを示し、メンバーの氏名、年齢、経歴、意図、行動を確認するものではありません。Carisma は、プラットフォームを通じて出会うメンバーの行動、経歴、相性について一切保証しません。
2. 会う際は自己責任で
他のメンバーとのやりとりについては、お客様のみが責任を負います。Carisma がユーザーを対面で審査せず、その行動を管理せず、プロフィールの真実性も確認しないことを、お客様は理解します。他のメンバーとやりとりしたり直接会ったりする際は、必要な安全対策をすべて講じてください。
3. 責任の制限
Carisma は人と出会う手段を提供するものであり、メンバーの行動を管理するものではありません。適用法で認められる範囲において、Carisma Dating、その所有者および運営者は、アプリの内外を問わず他のメンバーの行為によって生じた損失や損害（他のメンバーとの連絡や面会により生じた身体的傷害、精神的苦痛、金銭詐欺、なりすまし（キャットフィッシング）、詐欺、財産の損害を含む）、および間接的・結果的損失について責任を負いません。本規約のいかなる内容も、当社の過失による死亡・人身傷害、詐欺、重過失・故意による責任、その他お住まいの国の法律で制限できない責任を制限または除外するものではありません。法律上の消費者の権利は影響を受けません。
4. 不正利用に関するお客様の責任
Carisma の利用中に本規約または法律に違反し（例えば、他のメンバーへの嫌がらせ、詐欺、加害など）、その結果 Carisma Dating、その所有者または運営者に対する請求が生じた場合、お客様は、適用される消費者保護法で認められる範囲で、それにより生じた損失、損害、弁護士費用を含む合理的な費用を負担することに同意します。当社自身の過失による請求には適用されません。
11. Apple に関する条項
本規約はお客様と当社との間のものであり、Apple との間のものではありません。Apple はサポートや保守を提供する義務を負いません。Apple はアプリに関する請求について責任を負いません。Apple およびその子会社は本規約の第三受益者であり、本規約を執行することができます。[Counsel: include Apple's minimum EULA terms, or use Apple's standard EULA plus these terms.]
12. 準拠法および紛争
本規約はイタリア法に準拠します。これは、お住まいの国で消費者として持つ権利に影響しません。
13. 変更
重要な変更の前に、アプリ内でお知らせします。
1. Who can use Carisma
You must be at least 18, legally able to agree to these terms, not prohibited from using the service, and not have been removed from Carisma before. One account per person.
2. Your account
Keep your sign-in details safe. You are responsible for activity on your account. Use your real name or a name you are known by, and photos of yourself.
3. Community rules
You agree to follow the Community Guidelines. No harassment, threats, hate, explicit or unsolicited sexual content, sexual services or escort solicitation, scams or requests for money, impersonation, spam, or anything involving minors.
4. Your content
You own what you post. You give us a worldwide, non-exclusive, royalty-free licence to host, store, check, translate and show it to other members only to run Carisma. The licence ends when you delete the content or your account, except for content kept for safety as the Privacy Policy describes.
5. Moderation
We check photos and videos before they are shown and review reports. We may remove content, limit features, suspend or ban accounts that break these terms or the law, and we will tell you why unless the law or safety prevents it. You can contest a decision by emailing [email protected].
6. Safety
We do not run criminal background checks and cannot guarantee anyone's identity or behaviour. A verification seal means our team approved a selfie against the profile photos — nothing more. Meet in public and read our safety tips. In an emergency, contact your local emergency services.
7. Carisma Premium
- —Premium is an optional, auto-renewing subscription of 1, 6 or 12 months, billed by Apple (App Store) or Google (Google Play) to your store account.
- —The price is shown in the app in your local currency before you buy.
- —It renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged within 24 hours before renewal.
- —Cancel in your App Store or Google Play subscription settings. Deleting your Carisma account does not cancel the subscription.
- —Refunds are handled by Apple or Google under their policies.
- —If Premium ends, international conversations stay readable but become read-only; nothing is deleted.
- —What Premium includes may change; we will tell you before changes that reduce it affect a period you have paid for.
8. Deleting your account
You can delete your account at any time in the app (You → Settings → Delete account). It is permanent.
9. Availability
We work to keep Carisma running but it may change, pause or end. We may update features.
10. LIMITATION OF LIABILITY AND ASSUMPTION OF RISK
1. NO BACKGROUND CHECKS
Carisma does not conduct criminal background checks and does not check official identity documents. What we do: every profile photo is checked before other members can see it, and if you choose to verify your profile, a member of our team compares your selfie with your profile photos. A blue seal means only that this selfie matched — it does not confirm a member's name, age, background, intentions or behaviour. Carisma makes no promises about the conduct, background or compatibility of any member you meet through the platform.
2. MEET AT YOUR OWN RISK
You are solely responsible for your interactions with other members. You understand that Carisma does not physically screen users, control their actions, or verify the truthfulness of their profiles. You must take all necessary safety precautions when interacting with or meeting other members in person.
3. LIMITATION OF LIABILITY
Carisma gives you a way to meet people; it does not control what members do. To the extent permitted by applicable law, Carisma Dating, its owner and its operators are not liable for loss or damage caused by the conduct of other members, on or off the app — including bodily injury, emotional distress, financial fraud, catfishing, scams or property damage resulting from communications or meetings with other members — or for indirect or consequential loss. Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited under the law of your country of residence. Your statutory consumer rights are not affected.
4. YOUR RESPONSIBILITY FOR MISUSE
If you break these Terms or the law while using Carisma — for example by harassing, defrauding or harming another member — and this leads to a claim against Carisma Dating, its owner or its operators, you agree to cover the resulting losses, damages and reasonable costs, including legal fees, to the extent permitted by applicable consumer law. This does not apply to claims caused by our own fault.
11. Apple-specific terms
These terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance. Apple is not responsible for claims about the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
12. Governing law and disputes
These terms are governed by Italian law. This does not affect the consumer rights you have in your country of residence.
13. Changes
We will give notice in the app before material changes.
